Brian D. Waller
Mr. Waller is a partner of the firm. He is an experienced
litigator and trial attorney who joined the firm in
2000. His primary areas of practice are criminal defense
and civil litigation in federal and state courts. Specifically,
Mr. Waller counsels and defends individuals and corporations
under investigation or prosecution for federal crimes
such as racketeering, securities fraud, bribery, corruption
of government officials, insurance fraud, environmental
offenses, bank fraud, computer crimes and mail fraud.
He also represents clients in state courts charged with
a variety of offenses including narcotics sales, Medicaid/Medicare
fraud, robbery, assault, and homicide. Mr. Waller also
defends corporations and individuals in commercial civil
matters and actions involving civil rights violations,
contract disputes, wrongful death, environmental litigation,
professional malpractice and personal injury. Mr. Waller
has also handled numerous criminal and civil appellate
matters.
Mr. Waller served as an Assistant District Attorney
in Bronx County, New York, from 1993 to 1998 where he
primarily prosecuted violent felony offenses and conducted
numerous jury trials and complex criminal investigations.
Subsequently, Mr. Waller was an associate at the law
firm of Ohrenstein & Brown, LLP, where he practiced
as a civil litigator. In that capacity, Mr. Waller litigated
and tried a wide variety of civil matters in the areas
of products liability, professional malpractice, municipal
liability, negligence, commercial disputes, subrogation
and construction accidents.
Mr. Waller received a B.A. from the State University
of New York at Binghamton in 1990 and a J.D. from Hofstra
University School of Law in 1993. He is admitted to
practice in New York State Supreme Court and United
States District Court for the Southern, Eastern and
Northern Districts of New York. He has also handled
various federal matters in the states of New Jersey
and Florida.
Mr. Waller is a member of the New York State Association
of Criminal Defense Lawyers, the American Bar Association
and the Bar Association for the City of New York, where
he has served on the Committee for Criminal Advocacy.
Mr. Waller is a Co-Chairman and panelist of the annual
continuing legal education program Privileges in
Civil and Criminal Litigation and has served on
the faculty for the annual seminar Taking and Defending
Depositions, both for the Bar Association for the
City of New York. He has lectured on such topics as
the The Crime Fraud Exception to the Attorney-Client
Privilege and The Tripartite Relationship in
Insurance Defense Law. Mr. Waller has appeared on
NBC news and is a regular expert legal commentator on
Court TV.
